NOYB clears class motion lawsuits and damages in Belgian courts

On October 29, 2020, the non-governmental organization co-founded by data protection activist Max Schrems, None of Your Business (“NOYB”) announced that it can now file representative lawsuits and claim damages on behalf of consumers for violating various laws relating to consumer protection ( including the Data Protection Act) in Belgium. In particular, in a decision published in the Official Journal on September 30, 2020, the Belgian Minister for Employment, the Economy and Consumer Protection recognized NOYB as a qualified entity under the collective action plan set out in the Belgian Economic Code. This approval is in anticipation of the implementation of the Collective Redress Directive, expected by 2022, which requires each EU Member State to put in place a collective redress mechanism.
