NCPCR urgently appeals towards Bombay HC’s ruling that “skin-to-skin sexual assault” is

The National Commission for the Protection of Children’s Rights (NCPCR); wants an urgent appeal against them recent judgment of the Bombay High Court.

Recently the Bombay Supreme Court ruled in one case that; although the perpetrator touched the chest of a 12 year old child; According to the POCSO law, it is not a question of “sexual assault”, as there was no skin contact.

The Bombay Supreme Court classified such an offense under the category of “outrage at the modesty of women” under Section 354 of the IPC.

The perpetrator was a 39-year-old guilty party while the victim was only 12 years old.

NCPCR wrote a letter to the Maharashtra chief secretary on Monday. The letter states that the verdict needs to be reviewed.

The Commission is the monitoring body under Section 44 of the POCSO Act 2012; calls on you to take the necessary steps on this matter and urgently appeal the judgment.
