Alabama Rep. Mo Brooks has filed a Capitol riot lawsuit

Rep. Brooks has since alleged that the lawsuit was illegally served.

Alabama Rep. Mo Brooks was served a personal injury suit from California Democrat Rep. Eric Swalwell.

According to CNN, Swalwell is trying to hold Brooks – a Conservative – accountable for his role in the Jan. 6 Capitol Uprising. Swalwell had reportedly failed to track down Brooks in the days before.

However, Swalwell’s lawyers successfully contacted them earlier this week – much to Brooks’ annoyance.

“Well, Swalwell FINALLY did his job, filed a complaint (to my WIFE),” Brooks wrote on Twitter. “The TERRIBLE Swalwell team committed a CRIME by illegally sneaking INTO MY HOUSE and assaulting my wife!”

In the same tweet, Rep. Brooks suggested that Swalwell’s trial server violated Section 13A-7-2 of the Alabama Bylaws, constituting a first degree trespassing criminal.

A Brooks spokesman told CBS News that the process server broke into Brooks’ house without his knowledge or the knowledge of his wife Martha. The same process server allegedly refused to go on request.

Brooks’ spokesman says there is video showing the encounter.

Swalwell, adds CNN, was forced to hire a private investigator after his own legal team failed to track down the Alabama Conservative.

Philip Andonian, an attorney for Rep. Swalwell, said Brooks’ allegations were baseless and Swalwell’s trial server had lawfully filed the lawsuit.

“Nobody entered or tried to enter the Brooks house. This accusation is totally untrue. A process server lawfully delivered the papers to Mo Brooks’ wife, as federal regulations allow, “Andonian told CNN. “This was after their initial efforts to avoid service. Mo Brooks has nobody but himself to blame for it happened. We asked him to forego the service, we offered to meet him at a location of his choice. Instead of working things out like a civilized human, he has been playing a teenage Twitter trolling for the past few days and has continued to evade the service. He asked that we serve him. We did just that. Most importantly, the complaint has been served and Mo Brooks can now be held accountable for his role in instigating the deadly uprising at the Capitol. “

CBS News notes that Swalwell’s lawsuit names the defendants Rep. Brooks, former President Donald Trump, Donald Trump Jr. and Rudy Giuliani.

Taken together, Rep. Swalwell says these men and their cohorts were directly responsible for instigating the January 6th Capitol Rising, which killed several people and injured dozens.
